MINUTES OF THE PUBLIC MEETING OF OCTOBER 11TH, 2005

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A at the Town Hall.

Public Hearings

7:45 PM  Request for Determination of Applicability  to cross a wetland area to observe soil testing for the feasibility of installing a septic system at Reed Street, Assessor’s Map 33, Lot 14-3 for David Bonney, 271 High Street, Hanson, MA.  (New Hearing)

Sean Chrisman read the Public Hearing Notice and the abutters list was verified.  Ms. Delaney removed herself from comment.  Dave Bonney asked permission to cross a small area of wetland to gain access to an upland area to do a perc test.  The plan under consideration was done in 1998.  Mr. Grattan had made a site inspection and said that the original wetland flags were still there.  Mr. Bonney would have to have the area re-flagged if it percs and he would have to file a Notice of Intent if the lot was proposed to be developed.

Motion to allow one trip into lot with an excavator for two or three test pits outside of the 50-foot setback to determine viability of the lot:  Ron Grattan

8:00 PM  Blanket Request for Determination of Applicability filed by the Town of Hanson Conservation Commission on behalf of property owners within the Town of Hanson seeking permission to:  1.  Conduct test pits related to a septic upgrade 2. Install an above-ground swimming pool within 50-100 feet of a resource area and not within a resource area (Bordering Land Subject to Flooding, Riverfront area) except as grand-fathered exempted in 310 CMR 10.58 (6).  Parcel addresses and assessor references vary dependent on individual requests filed.

Sean Chrisman read the Public Hearing Notice.  Ms. Delaney made a presentation for approval through a Blanket Request for Determination of Applicability, which had already been filed with the DEP, for minor projects that are exempt under the State Wetlands Protection Act but not under the Town By-law.   The Request would implement a blanket review for tests pits and above ground swimming pools.  Since the public hearing process would be eliminated, it would cut down on time involved.  There would be a $50.00 fee that pays for an initial and a follow-up inspection by the agent.  The wetland line is determined at the test pit stage so it is confirmed before a system is designed.  An applicant must then have a Board of Health approved plan maintaining a 50-foot setback from the resource area and to show the limit of work.

8:15 PM Continued Notice of Intent for the construction of a garage at 76 Woodbrook Lane, Map 116, Lot 5-6A, Hanson, MA for Shaun MacPherson, owner   (DEP #SE175-___)

Mr. MacPherson presented a revised plan showing the relocation of the proposed garage to the end of the driveway which conversely is out of the 100-foot Riparian zone.   The dimension of the garage as shown was 30’ x 36’.  The Commission requested that he reduce the size of the garage to maintain at least a 10-foot buffer from the wetland and to provide more extensive mitigation along the back of the lot in order to improve the conditions necessary to meet Rivers Protection Act Redevelopment standards.  In addition, Mr. Lindquist said that Mr. MacPherson would have to demonstrate a hardship through a variance request to perform construction within the 50-foot no disturb zone.The lot was developed in 1996 before the 50-foot setback regulation was in effect.

Appointments

8:30 PM  Informal Meeting with Roy Vinton & Steve Giosa regarding Lot 4A on Valley Forge Road

Mr. Vinton and Mr. Giosa of SITEC attended the meeting for a follow-up conversation from the last meeting.  Mr. Giosa gave a brief overview of a proposal for a wetland replication area to make room on the lot for a single-family house.  Ms. Delaney had made a site inspection.  There were no wetland flags on site and the wetland appeared to be larger than as shown on the plan.

There also appeared to be a small brook with running water not shown on the plan.  The lot was created in the late 1990’s.  Ms. Delaney reiterated that the 50-foot no disturb zone regulation was enacted on February 10, 1998.  The Commission suggested to Mr. Vinton to have the lot flagged accurately so that they can advise him accordingly and find out when the lot was created.  

8:45 PM  Informal Meeting with Angelo D’Emilio regarding 1139 Main St. (DEP #SE175-0460)

Mr. D’Emilio and Bob Crowell from Land Planning, Inc. presented a new plan for the above-mentioned property.  Ms. Delaney informed them that in the future, if a plan is not received at least seven days before a meeting, the Commission would not review it.    That said, Mr. D’Emilio was proposing to construct an 8-unit condominium with associated parking and septic system.  He wants to acquire an abutting lot to satisfy Title 5 requirements.  The Commission advised Mr. D’Emilio to come back with a detailed plan, dated and stamped by the engineer and a new hearing would be scheduled.  The hearing will have to be advertised in the local paper.

Request for Certificate of Compliance for Clarence Lyons, 112 Union St., Map 30 & 31, Lots 2-1 & 2 (DEP#175-373)  - still waiting for as-built (HOLD)

Request to Review a Revised Plan for Alan J. Dias for 751 Whitman Street, DEP #175-0473

Mr. Dias had submitted an after-the-fact revised plan approved by the Board of Health showing the elimination of a retaining wall for a septic system.  The new property owners, Mark & Lynn Riehl, attended the meeting and voiced their disappointment over the change in the plan of record as they were never told of the revision.  They informed the Commission that the system was eroding into the driveway.  The Commission decided to write a letter advising the owners to work with contractor (Mr. Dias) to try to resolve the issue.  The Commission did not approve the new plan.

Stormwater Management Workshop, MassDEP – Dave, Janine and Phil will attend at no cost

Letter from residents of Acorn Road & Forest Trail requesting a conservation inspection of Lot 7 on Acorn Road owned by Melody Lindsay. – Ms. Delaney will draft letter to owner requesting permission to access the site.

Police Station site inspection Ms. Delaney reported that she had made inspection of the site.   

Erosion Control for Lakeside Road and a small correction for a typographical error on the Order of Conditions   (DEP #175-395)
